I just became unemployed (today) but I obtained my GC through employment about 2 years ago. I have some questions:
I am planning to spend about a week or 2 in Canada, will that cause me any problems when I come back to the US? I will keep job hunting in Canada but for a job in the US as I intend to stay in the US.

I posted the same kind of question in murthy forum and I got a reply that education requirement is not needed once I140 is approved which determines EB2/EB3. So I guess we can port to any job which is similar/same. Don't take my word and do your own research for exact info.

C# is a .NET language! C++, though, can either be .NET (managed) or unmanaged. You should clarify that with whatever job you are hoping to work on :)
The thing about .NET is that its main language is MSIL (Microsoft Intermediate Language). All of the .NET languages such as C#, VB, C++, etc. get squashed into MSIL.
I am utterly confused here. I see different jobs and stuff for .NET or c# or c++, etc. I thought they were all a part of .NET? Why for example, are the forums c# separated from c++, when they are both part of the same framework? I seriously can not wrap my head around this. If somebody says "I need some .NET work", are they referring to any language within .NET, like c# and c++? Please help me!

Hi All,

1. I am married and have a kid and are staying in India right now. There is a section on AINP 009 form which asks for spouse's and kid's signature as well. So please let me know if I can submit the application AINP 009 form now without my their signature's as they are not with me in USA? or is it mandatory to have their signature's (it
would take couple of weeks for me to get it signed if required). Please advise.
2. Also on CIC application family details form it asks for brothers/sisters addresses. Does complete address need to be mentioned or just city/town and country suffice?
3. Will there be any interview for PNP programs i.e. once the province sponsers me then I will need to apply to CIC..right? Will I be called for any interview for final decision of PR?

I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

"I lost the paystub" is crap. On the flip side what were you doing for the three months waiting for it?
Ask him to print the duplicate from your payroll system....this should not be an issue at all if he is not trying to hide anything.
There is a good chance that the visa officer will ask you to prove your legal status on H1 and you may have to do a lot of explaining about the change in status.
It just seems like something is not right here

Sorry to hear about your situation. You are out of status the minuet you lost your job and the 180 days clock has already started ticking i.e. out of status for more then 180 days and still in the country may result in 5 yr entry ban.
I don't want to scare you but just sharing the law details.
Now you best course of action would be to get a job ASAP and get your H1 transferred. For this process immigration will ask for your last pay stub and if there is a big gap then they might reject your visa but again it is hard to say anything as it totally depends upon the officer.
Also, hire a good attorney if you can.
Staying in the US after losing a job on H1 is a gray area, especially when you have a valid i-94 hence getting a good attorney is very important.
Also, you might want to look at student visa or visitor visa to maintain your legal status.

Can i work for another company...without transferring my H1 and can i get a 1099 Misc....( they cannot run my payroll as i wont be employed with them)....the work is in the same field...
if 1099 is not feasible.. the only option is to get paid in cash..which i dont want to do..

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-)
Don't know its good or bad. Any idea anyone?

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.
